Omar Zambrano - Can Your Relative Fight Mandatory Detention? | Los Angeles | The Law Offices of Omar Zambrano - Free Consultation 1-800-985-8650

Mandatory Detention Provisions are some of the harshest aspects of immigration law today. There are no guarantees that your family members will be allowed to bond out of custody or released from immigration detention centers.

If your relative is classified as an arriving alien, aggravated felon or a terrorist by the government, he may not be entitled or granted a bond hearing.

These rules are affiliated with highly technical classifications, but should never just be accepted as the government's interpretations of these guidelines.

After all, these categories have been under the observance of numerous law suits, filed by immigration bond attorneys who seek to protect immigrants whose day in court got denied.

It so happens that immigrants who have been convicted of certain crimes may not be eligible for bonds under these mandatory detention provisions. These include convictions for drug trafficking and fire arm defenses. In a variety of cases, the detained immigrant only has served 3 days in county jail, has paid a fine, and finished probation requirements over 20 years ago.

It may be, that your family member wasn't arrested or convicted of a felony because of the crime alleged by the government. He may have been guilty of the crime, but the crime is not falling under those warrants, that qualify for mandatory detention. These types of cases may last for months, even years, and ma require a bond hearing attorney to file an appeal in your immigration case or the case of your relative.

In these cases, the deportation of the individual is on the line, and nothing less than a good and experienced immigration bond attorney may be able to help your family and your relative get through this fight against the removal from the U.S.A.
